Federal Court Agrees to Let Democrats Defend Obamacare in Court

As reported in earlier Washington Updates, a federal district court in Texas ruled, in Texas v. Azar, that the entire Affordable Care Act (ACA) is unconstitutional, as claimed by the plaintiffs – Republican attorneys-general from about 20 states. The district court allowed Democratic attorneys-general to intervene in the case, which is now on appeal to the Fifth Circuit Court of Appeals. Last week, the appeals-court judge allowed the House of Representatives to intervene in the case, since there is no one else defending the law. (Normally, the Department of Justice defends statutes that are being challenged in court. The Trump administration, however, sided in part with the plaintiffs challenging the law, arguing that some parts of the law are constitutional while others are not.)
